 主  旨  教育部函示:有關校園性別事件之保密義務適用範圍及法律責任,請查照。Confidentiality Obligations and Legal Responsibilities in Campus Gender-Related Incidents
 內  容 
一、依據性別平等教育法(以下簡稱性平法)第23條第2項規定及114年12月22日立法院召開「檢視性別平等教育法在教學與事件處理之實務困境」公聽會會議紀錄辦理。
二、對於校園性別事件當事人及檢舉人之姓名或其他足以辨識身分之資料,除有調查之必要或基於公共安全之考量者外,應予保密、不得揭露當事人之姓名或其他足以辨識身分之資料及非有正當理由,不得公布行為人之姓名或其他足以辨識身分之資料,係定於性平法第23條第2項、第27條但書及第28條第4項。學校或其他人員(校內)違反者,由主管機關依據性平法第43條第2項規定,處新臺幣1萬元以上15萬元以下罰鍰,合先敘明。
三、校園性別事件防治準則第24條第4款前段復規定:「事件管轄學校或機關調查處理校園性別事件時,應依下列方式辦理:......四、就行為人、被害人、檢舉人或受邀協助調查之人之姓名及其他足以辨識身分之資料,應予保密。......」第25條第1項規定:「依前條第4款規定負有保密義務者,包括參與處理校園性別事件之所有人員。」及第2項規定:「依前項規定負保密義務者洩密時,應依刑法或其他相關法規處罰。」
四、承上,有關參與校園性別事件處理之學校或主管機關人員(師長、行政相關人員、擔任檢舉人之學校教職員工等),倘運用網路、實體或私下等各種場域論及案情或當事人資料之情形,是否涉及違反性平法所定保密規定一節,學校及主管機關於知悉後,自得依法將該疑似違反性平法事件交所設性別平等教育委員會調查處理,調查屬實者除依相關規定議處外,並應依性平法第43條第2項規定,報主管機關處以罰鍰。
五、至該等學校及主管機關參與處理人員或未參與處理之其他人員、與該校園性別事件不相關之人(包含學生),運用網路、實體或私下等各種場域論及案情或當事人資料,是否涉及違反個人資料保護法、性侵害犯罪防治法或相關民、刑法所定洩密規定,自應由其個人自負法律責任。倘當事人向地方檢察署告發,學校及主管機關當有義務配合司法機關調查。
Notice on the Scope of Confidentiality Obligations and Legal Responsibilities in Campus Gender-Related Incidents

In accordance with Article 23, Paragraph 2 of the Gender Equity Education Act (GEEA) and the conclusions of the Legislative Yuan public hearing on practical challenges in the implementation of the GEEA, schools and relevant personnel handling campus gender-related incidents are required to strictly observe confidentiality obligations.

Information that may reveal the identity of the parties involved, whistleblowers, or individuals assisting in the investigation must be kept confidential, unless disclosure is necessary for investigation purposes or based on public safety considerations. The names or other identifying information of the parties involved or the alleged offender shall not be disclosed without justifiable reasons.

All personnel participating in the handling of campus gender-related incidents are subject to confidentiality obligations. Any violation may result in administrative penalties under the GEEA, including fines ranging from NT$10,000 to NT$150,000, and may also be subject to disciplinary action.

Individuals who disclose case details or identifying information through online platforms, in-person discussions, or other means may also bear legal responsibilities under relevant laws, including the Personal Data Protection Act, the Sexual Assault Crime Prevention Act, or other applicable civil and criminal regulations. Schools and competent authorities shall cooperate with judicial authorities if a case is reported for investigation.
